Privacy Policy

This Privacy Policy explains how Capwell Comm, Inc. ("Capwell," "we," "us," or "our") collects, uses, and discloses information when you visit capwellcomm.com (the "Site") or contact us. By using the Site, you agree to this Policy.

2. Information we collect

Information you provide

When you use our forms, you may give us:

  • Contact form (on our homepage): your name, company, phone number, email address, and any message you send.
  • Intake survey (on our Contact page): the responses you provide about your PR goals and your contact details.

Information collected automatically

When you visit the Site, we and our service providers automatically collect certain technical information, including your IP address, browser and device type, pages viewed, and similar usage data, through cookies and analytics (see our Cookie Policy). Loading certain page resources (fonts, icons, and embedded content) also shares your IP address with the providers that host them.

3. Sources of information

We collect information directly from you (through our forms), automatically from your device as you use the Site, and from the service providers that help us operate the Site and analyze its use.

4. How we use your information

In the preceding 12 months, we have used personal information to:

  • respond to your inquiries and provide our services;
  • operate, maintain, and improve the Site;
  • understand how the Site is used (analytics);
  • protect the Site against spam, fraud, and abuse; and
  • comply with legal obligations.

5. How we share information

We share personal information only with service providers who process it on our behalf for the purposes above, including:

  • Google (analytics and reCAPTCHA spam protection; web fonts);
  • Netlify (website hosting and form handling);
  • GoHighLevel and Simplicity Digital (our customer-relationship and intake-survey provider);
  • content-delivery networks that host fonts, icons, and images.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We may also disclose information if required by law or to protect our rights.

6. Your California privacy rights

Although Capwell is a small business that is not required to comply with the California Consumer Privacy Act, we voluntarily honor the following California privacy rights:

  • Right to know what personal information we collect, use, and disclose;
  • Right to delete personal information we have collected;
  • Right to correct inaccurate personal information;
  • Right to opt out of the sale or sharing of personal information (note: we do not sell or share it);
  • Right to limit the use and disclosure of sensitive personal information (note: we do not use sensitive personal information for purposes that require this option); and
  • Right to non-discrimination for exercising these rights.

7. How to exercise your rights

To make a request, email us at info@capwellcomm.com with "Privacy Request" in the subject line. To protect your information, we will take reasonable steps to verify your identity before responding, and we may need enough information to locate your records. You may use an authorized agent to submit a request on your behalf provided they supply written proof of authorization and we can verify your identity.

We aim to respond within 45 days of receiving a verifiable request. If we need more time (up to 90 additional days), we will notify you of the reason and the extension period within the first 45 days. You may submit no more than two requests in any 12-month period. We will not charge a fee unless requests are excessive, repetitive, or manifestly unfounded — in which case we will tell you before proceeding.

8. Do Not Sell or Share My Personal Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. As a voluntary courtesy to California residents, you may adjust your analytics preference at any time using our privacy preference center. If our broader practices change, we will update this Policy and provide any opt-out method then required. To ask about how we handle your information, contact info@capwellcomm.com.

9. "Shine the Light" (California Civil Code § 1798.83)

California residents may ask once per year whether we disclosed their personal information to third parties for those third parties' own direct-marketing purposes. We do not. To inquire, contact info@capwellcomm.com.

10. Do Not Track

Some browsers send a "Do Not Track" (DNT) signal. There is no common industry standard for responding to DNT, so the Site does not currently respond to DNT signals. We do not authorize third parties to track your activity across other websites for advertising. You can control cookies as described in our Cookie Policy.

11. Data retention

We keep personal information only as long as reasonably necessary for the purposes described in this Policy. We generally retain leads from our contact form and intake survey for up to 18 months, after which we delete or de-identify them, unless a longer period is required by law or to resolve a dispute.

12. Financial incentives

We do not offer any financial incentives or price differences in exchange for the collection, retention, or sale of personal information.

13. Security

We use reasonable administrative and technical measures to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

14. Children's privacy

The Site is intended for a general business audience and is not directed to children. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.

15. Third-party links and embeds

The Site may link to or embed third-party services. We are not responsible for their privacy practices; please review their policies.

16. Changes to this Policy

We may update this Policy from time to time. The "Last updated" date above shows the most recent revision. Material changes will be posted on this page.
